Our Process
When it comes to the legal demands and requirements of the Medico-Legal Industry, Dr Pretorius Inc prides itself in following a detailed and in depth approach to provide extensive, validated guidance that will stand solid in any court room or hearing.
A holistic approach is followed from case acceptance and communication on requirements following through to a detailed assessment and report compilation process culminating with direct, accessible support from expert to legal team till completion.
With each case starting during an initial in-depth assessment (in person or via online platforms), Dr Pretorius Inc follows through by assessing the needs and requirements (including other experts advise) and collection of collateral information (employer interviews, collection of documentation, etc).
Reports are compiled following thorough analysis of expert advise, consultation with relevant parties (including collateral discussions with employers), career evaluations and industry benchmarking. Additional assessments, follow-up interviews, work place visits, etc, can be recommended (if needed) and performed.
Once reports are compiled it is placed through internal evaluation for quality, consistency and accuracy before submitted to the legal parties (and if needed with further direct communication on additional needs to bolster the case).
After completion of the report, experts remain at the disposal of the legal parties for updates, addendums, joint minutes, pre-trail meetings and ultimately readily available to testify or simply provide further advice on the day, when needed.
RAF Claims
Within the RAF domain, Dr Pretorius Inc places high care in following a detailed approach (Our Process), not only to evaluate the impact of the accident on the individual’s career, but also on what would probably have been if the accident never occurred.
Working in tandem with the Legal Parties a thorough case assessment is performed and arguments are constructed based on relevant and accurate information (expert reports, validated documentation, collateral work place feedback and visits if needed).
Continuous support is provided to the Legal Parties in terms of understanding the scope and degree of arguments related to the individual’s career.
RAF Assessments are provided on: Face-to-Face Assessments at Dr Pretorius Inc Premises, Virtually via Zoom or Teams (subject to strict policy to ensure quality), Travel to either Legal Firm of Attorney or location of claimant (for those that are hospitalised, in home care or otherwise medically unable to travel).
Loss of Support
Loss of Support matters can be very taxing and emotional on the surviving members, Dr Pretorius Inc thus takes great care in assessing such matters. Following a similar approach (Our Process) an evaluation is performed on several parties;
- The main claimant (mother/wife, father/husband or legal guardian) to establish their career and income generating potential both from the view of “if the deceased had not passed” as well as what is now expected of the claimant.
- The deceased, to establish what career potential the individual would have held, which is often done by extensive consultation with employers and based on the individuals past profile (work history and qualifications).
- The dependent children and how the loss has affected their life, specifically in terms of the support they would have enjoyed in preparation for their own independence and up to the point of their own independence.
- Other Dependents which may extent to disabled siblings or family that the deceased was caring for.
Medical Negligence
While medical negligence remains a delicate subject within the medical field, it is important to provide support and assistance to those individuals who have been affected by the impact thereof. It is therefore necessary that not only the burden of responsibility be established (in terms of the medical practitioner at fault) but also to determine the extent of impact that this would have on the individual.
While care is important for such an individual, the extent of this impact caries further than just the medical needs, but also the career and earning impact that this would have on an individual. From a child who is no longer able to enter the labour market to an individual who’s career has been curtailed due to loss of capacity, Dr Pretorius Inc applies the same dedication and thorough assessment (Our Process) to the investigation of the matter.
Through a thorough industrial psychology evaluation Dr Pretorius Inc aims to provide the parties with clear guidance on the long term financial impact that such an event has on the individual in terms of the career prospects that are loss.
